Supreme Court to Hear Challenge to Trump's Tariffs
The Supreme Court will hear oral arguments next week in a high‑stakes challenge to President Trump’s sweeping tariffs imposed under the International Emergency Economic Powers Act (IEEPA). A lower court has already ruled those IEEPA‑based tariffs illegal, and a bipartisan group of 207 lawmakers filed an amicus brief arguing IEEPA cannot displace Congress’s exclusive tariff powers. Trade experts and some observers say the Court may be likely to rule against the administration, which could trigger collective refunds estimated at hundreds of billions to as much as $1 trillion and has already hurt U.S. companies (one toy maker expects sales to fall about 25%). Even if the IEEPA measures are struck down, much of the administration's tariff architecture—including 50% steel and aluminum duties and measures imposed under Section 232 and Section 301—was enacted under other statutes and could remain in place. President Trump has publicly accused Canada of trying to influence the case and said he may attend the oral arguments, a move critics call an unprecedented attempt to influence the Court.
